Terms of Use

1. Who we are and what you're agreeing to

BookedSolid ("BookedSolid," "we," "us") provides a booking and customer-management platform for local service businesses. By accessing the service, creating a password, or using an account prepared for your business, you agree to these Terms of Use and to our Privacy Policy. If you use the service on behalf of a business, you represent that you are authorized to act for that business and that these terms bind it.

The service is currently offered as a beta: features may change, and we may contact you for feedback.

2. Personalized demo previews

We may prepare a non-public, personalized preview of the service for a business ("Demo") using publicly available information— such as the business's name, locality, and the services it advertises — so the business can evaluate the product in a realistic form. Demos:

(a) are accessible only via a private link sent to the business and are not published, indexed, or marketed to the public; (b) do notimply any affiliation with, sponsorship by, or endorsement from the business — all business names and trademarks remain the property of their respective owners and are used only nominatively, to identify whom the preview was prepared for; (c) contain clearly fictitious sample data, labeled as such; (d) do not use a business's logo or other brand assets unless the business provides or approves them; and (e) will be deleted promptly on request — email us at the address in Section 16 and we will remove the Demo and suppress further contact.

If you received a Demo invitation and do not want it, you may simply ignore it; unclaimed Demos are deleted in the ordinary course. Activating a Demo (signing in and creating a password) converts it into your account under these terms.

3. Accounts and security

You are responsible for maintaining the confidentiality of your password and sign-in links, and for activity under your account. Sign-in links are single-use and expire; treat them like a password. Notify us promptly of any suspected unauthorized access.

4. Trials, subscriptions, and postcard orders

New accounts include a free trial (currently 90 days; the length shown in your account governs). No payment method is required for the trial. At the end of the trial the account locks until you subscribe; your data is retained per the Privacy Policy.

Paid plans are billed monthly or annually at the prices shown at checkout. Plans renew automatically until cancelled; you may cancel anytime, effective at the end of the current billing period. Direct-mail (postcard) orders are separate, per-order purchases priced at the quoted amount before you approve the order; once an order is submitted for printing it cannot be cancelled. Prices exclude applicable taxes.

5. Your customer data

As between you and us, you own the customer records(contacts, appointments, notes, reviews) you store in the service. You grant us the limited rights needed to host, process, back up, and display that data to operate the service. You are responsible for having the right to store the personal information you enter about your customers and for honoring their requests under applicable law. The "Reset CRM data" control and deletion requests under Section 16 permanently remove these records.

6. Acceptable use

You agree not to: use the service to send spam or unlawful communications; upload malicious code or attempt to breach the service's security or other tenants' data; misrepresent your identity or authority to act for a business; scrape the service; or resell it without our written agreement. You are responsible for your own compliance with laws that apply to your business's communications with its customers (including CAN-SPAM, TCPA, and GDPR where applicable).

7. Direct mail

Postcard campaigns are printed and delivered by third-party print and postal providers. You are responsible for the content of your cards (we provide templates as a convenience) and represent that your campaigns comply with applicable advertising law. Delivery timelines are estimates; postal handling is outside our control.

8. Intellectual property

We own the service, its software, templates, and generated designs (excluding your business name, your logo, your trademarks, and your customer data, which remain yours). You receive a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. Feedback you give us may be used to improve the service without obligation.

9. Third-party services

The service interoperates with third parties — including calendar applications you subscribe to feeds with, Google Business Profile (which you configure in your own Google account), payment processors, email providers, and print providers. Their terms govern your use of their products; we are not responsible for their acts or omissions.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NEVER BE LOST — KEEP INDEPENDENT RECORDS OF CRITICAL INFORMATION.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR, IF YOU HAVE PAID NOTHING, FIFTY U.S. DOLLARS). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE JURISDICTIONS, MANDATORY CONSUMER RIGHTS REMAIN UNAFFECTED.

12. Indemnity

You will defend and hold us harmless from third-party claims arising out of your customer data, your campaigns and communications, or your breach of these terms.

13. Termination

You may close your account at any time. We may suspend or terminate accounts that violate these terms or create risk for the service or other tenants, with notice where practicable. On termination, Sections 5, 8, and 10–15 survive; you may request an export of your customer data within 30 days.

14. Changes

We may update these terms as the service evolves. Material changes will be notified in-app or by email; continued use after the effective date constitutes acceptance.

15. Governing law

These terms are governed by the laws of the State of Louisiana, USA, without regard to conflicts of law, and disputes will be resolved in the state or federal courts of East Baton Rouge Parish, Louisiana. If you are a consumer in the EU/EEA, this does not deprive you of protections that cannot be waived under your local law.
